            <description><![CDATA[ I agreed to have an Intoxalock installed so I can drive legally. Nobody said anything about me being tracked by gps. There is now a small antenna on driver side dash that must be for gps. After all the meetings I had about this whole interlock deal nobody said that they were going to keep track of me day and night. I did not sign up for this. Is that what they are doing? I called them and they could not or would not give me a straight answer.<br />
What do you say? Is it legal to just track someone with out disclosure?<br />

            <description><![CDATA[ the rolling tests after a warn will in fact get your license revoked. If it was mouthwash, that's another story. <br />

In the papers I received you initial that you understand what a warn is by definition. <br />

The tricky thing is it allows you to drive with a warn, doesn't mean you should. <br />

I had to look over my papers again, but have never got a warn. You can't really drink to excess when this is in your car the previous night, <br />
<br />
unless your certain you have waited long enough. Sometimes you have to wait like 18 - 24 hours. <br />
<br />
If not the breathalyzer will give you a viol. It only takes .02, not .04 / .06. <br />
<br />
I'm thinking this guy from NY got his license revoked. Again you have to wait, for example you drink 12 heinekins at 11pm. <br />
<br />
You have to wait 24 hours. You can't drive until 11pm the next day depending on your height , weight may be longer or shorter. <br />
<br />
If you drink 9 Heinekens at 11pm you could drive around 6pm, but again that's 19 hours. It's a long time, but better than getting a lockout. <br />
<br />
Any lockout looks bad even the start-up lockouts, plus it's 50 dollars as well. 2 lockouts for start-up's 10 year revocation. Fuck it<br />

I'd rather get a felony and a third dui than lose my license for 10 straight years.]]></description>

            <description><![CDATA[ Hello, same thing here,coming back from Florida...got stopped going 86 in a 70...asked officer how much he thought ticket would be, no mention of Super Speeder Law......I also called court house to see about appealing it. Iive in Warne,N.C. which would have been a 6 hour drive. I paid fine but if she had told me on the phone about Super Speeder I would have made a journey to Valdosta , no mention of it at all.This truly sucks, Priscilla Krenmayer]]></description>

            <description><![CDATA[ We moved back to NC specifically for my husband to get his license back. I got a  job at the hospital and he finally after getting his license landed a great job that we depend on financially. We share a vehicle and have had to have the unit head replaced three times since installation end of Feb. I had a couple of warns during first few weeks of having it on car during breaks at work. We had our first download on march 25th and installer said nothing about a violation. He did say our device was faulty and had to replace it and if it ever said &quot;abort offset&quot; again that we should immediately tell him so he can replace the one he just replaced. A letter was sent to my husband on april 12th from nc dmv stating his license will be suspended for another year due to violation of interlock law or nc alcohol statues. What? There was no violation. I didnt receive this letter in time due to my husband medication change which caused agoraphobia and sever panic attacks during the month of april. I work nights so don't check the mail everyday. So his license is suspended and missed window to get hearing.Our attorney sent a letter and doctors letter to show reason for not getting mail in time which dmv requested a reason why mail wasnt gotten. <br />
Our attorney's office called installer he said he would write letter stating he was aware of the faulty unit head and that he changed it. But two days later said we would have to go through smart start corporate because he cant be involved in legal matters. My question is if we get smart start to show that the unit was faulty and send that to dmv can we still get a hearing? Also the medical reason the mail wasn't checked which we provided to dmv through attorney wouldn't that be enough? And how long does it take to hear back from dmv after they received the letter?They sent us our first hearing not authorized letter on may 7th requesting us to provide reason for not getting the notice of suspension letter. May 21st response/proof of reason letter from the attorney and doctor  was sent to dmv. Has anyone had success in receiving a hearing after the 10 day window? Is there anything else we can do if we are still denied a hearing? It wasn't even a violation it was a warn and both of the warns on the logs say .0007 as reading. How is that above the threshold of violation? IT WAS A WARN AND A FAULTY UNIT HEAD. Oh and by the way I asked if we could get the camera installed we would pay the extra for it and the installer said that it is not offered in NC... wow..]]></description>

On May 3, 2013, I received a traffic citation on Interstate 75 in Turner County near Ashburn, Georgia.  The citation number is REDACTED and was for driving 86 mph in a 70 mph zone. This citation was incorrect; at the time I was driving 75 mph in a 70 mph zone. The highway patrol officer, Bobby Caton, insisted the state’s speed device was correct, but I know I was driving 75 mph.  So, either the speed device was incorrect, or it was aimed at a different vehicle.  At any rate, the highway patrol officer issued a citation.  I have paid the fine ($282.00) for that citation, not because I am guilty (I am not), but because I can’t afford the time or the gas to come back to Georgia to explain the facts to the court.  Yesterday, I received a notice from the State of Georgia telling me that the traffic infraction for which I have been judged guilty carries an additional fine of $200.00. I have been wrongly convicted of one crime twice.<br />
<br />
As you have directed, enclosed is an additional cashier’s check for $200.00.  To be clear, I am guilty of driving 75 mph in a 70 mph zone. But, I am not guilty of driving 86 mph in a 70 mph zone nor am I guilty of driving the excessive speed which would result in the additional fine of $200. Please understand I know both the original speeding ticket and this additional “super-speeder” fine are based on a fabrication created by a State of Georgia highway patrol officer, and this lie is the responsibility of the State of Georgia to correct and to ensure it never happens again.<br />
<br />
Note that it appears the State of Georgia has created a false Driver’s License for me (LIC. NO REDACTED). It is against Florida law for me to have an active driver’s license in both Florida, my state of residence, and any other state.  If the State of Georgia has established a driver’s license under my name, you must cancel it immediately and remove all records of its existence. I have never applied for a driver’s license in Georgia and it appears the State of Georgia has stolen some of the personal identity information contained on my Florida driver’s license to create a new identity with a Georgia driver’s license.<br />
<br />
Because of this incident, and the dishonesty of the State of Georgia, I will do my small part to ensure that the people I know, and the people they know, avoid travelling through, or spending money in, your state. It seems pretty clear to me that your husband is eating or drinking something thats causing false positives. HUGE amounts of things can cause false positives, not just mouthwash or hairspray or other obvious things. <br />
<br />
The situation is, you cannot eat/drink 15 minutes before blowing, and you must swish with water before you blow. <br />
<br />
You probably need to find out the rules about other people driving your car. I am the only person who is ever in my car. I dont even let mechanics blow into it. When I have car work done, I stay with my car the whole time, and I blow into it if/when they need it to start. I have worked too hard on this to be ruined again b/c of what someone else has done (eaten or drank). If you find out that its not allowed, you really should set up a different driving arrangement where you are the only person driving that car. That could be in your favor at the hearing, that you are being pro-active.<br />
<br />
With a 3 yr revocation, your rolling test used to have to be under .004.  Now, it must be .000.  The only way to do that is to be sure you have absolutely NO sugar residue in your mouth when you are driving. DMV koows that the legal limit is .080, and they know that .010 is extremely low, and usually is sugar residue. But they have overwhelming lobbying, and they have to respond to that.  Are any of your rolling tests followed by ,000? That would be what you need to show that it was food residue, not drinking, that caused the false positive.]]></description>

After a certain amount of violations you get a service lockout.  Meaning that if you do not go in within that amount of time the device will just lock you out no matter what.  You are going in so the installer can check the condition of the device.]]></description>

The day we went in for that service check when the device went crazy is the date of the non-compliance report. Under reason it says:<br />

I have no idea what to make of this- 5:30 in the morning is when my husband leaves for work, 5:30 in the evening is when he comes home. They've had mandatory overtime for I don't know how long. And my husband doesn't drink at all. I know it doesn't matter to the DMV who was driving the car and I don't plan to try to argue or prove that my husband had the car, but I don't know how to defend myself against a running test of .01 if obviously the test to start the car didn't register anything. It doesn't even tell me what the tests before and after show so they look like isolated incidents that happened after the car started without detecting anything at all. I know it will start if the BAC is low enough but if there was anything the device detected, I would think it would be listed here. <br />

And what does &quot;Vehicle Off Test Ignored&quot; mean? We definitely never ignore a test. I've pulled over on the side of the road many, many times to do the start tests where you have to turn the car off and then test again to get going. We don't ever ignore a running test or anything having to do with the device. I am terrified of losing my license. This is more stress than I can handle. I have a chronic illness, I have two toddlers so I've always got a doctor's appointment to go to. And if they take my license for a year and then put this thing back on my car for another three, what's to keep me from complying for over a year like I have now and something like this happening again?<br />

Does the DMV recognize the margin of error and do they take it into consideration? I would think so, but if they do, why are they calling me in? I don't understand why it's not obvious that this was not a case of drunk driving. If anybody can help me with any of these questions I would be very grateful. Thanks.]]></description>

Hopefully you have requested your file. That should explain what you need to know. It really sounds like a device problem. <br />

You shouldnt be concerned about the ?false starts;  if you turn off your engine, the NC device gives you a small amount of time to re-start it. If you had gone over that period of time, you would not have been able to start your ignition without blowing again. <br />
<br />
My hearing was nerve racking. I have been through a lot of turmoil and losses that are un-related to the dui. The entire idea that I could lose my license AGaiN doing Nothing, was very, very disturbing. It stil is, because there is a lot of potential for error without even drinking one drop of alcohol. <br />
<br />
But it went ok. I just told the truth, and brought my file in with me. I was also prepared to demonstrate proper use of the device, including pre-swish with water. But I wasn't asked to demonstrate. <br />
<br />
I just keep trying to move forward and stay as positive as possible.]]></description>

            <description><![CDATA[ Same story -May 6, 2013 - on my way to Florida.  Pulled over in Conyers, GA. - Turner County.  First ever speeding ticket - states I was going 85 in a 70 - NO WAY.  I looked down at my speedometer when I saw the officer shooting radar on the side of the interstate and I was going 81.  I immediately pulled my foot off of the accelerator thus my car was slowing down from 81.  Yes, this was speeding but I figured I was okay due to I was in the middle lane and was being passed in the fast lane by a thousand cars!  He pulls out and my husband said, &quot;Here he comes and he's going after that truck that just flew passed us.&quot;  WRONG...he pulls in behind me.  I pulled over and he claims I was going 85.  I told him that I was going 81 according to my speedometer and he says nothing.  He takes my license and heads back to his patrol car.  A few minutes later he hands me a ticket.  I was pissed because he insisted I was going 85.  I asked him how much it would be and he just pointed to a phone # on the back of the ticket and told me to call in about 10 days.  I did just that and was told I had to pay $282.00.  I nearly threw up over the phone.  $282.00!!!  Like every else, I paid it because it would have cost me alot more to make a trip from Chattanooga, TN. to Conyers, GA. to go to court.  Yesterday, I get this SS bill in the mail.  I too thought it was a scam.  I called the phone # and a lady informed me it was no scam and the money was being used to support the new trauma center at Grady Memorial in Atlanta - nice thought but I doubt VERY SERIOUSLY that it's being used for that!   I've been given till September 2013 to pay or my license gets revoked.  Is Georgia crazy! <br />

Since then I have woken up to go to work and the device has given me a Test Failed 3 times. So I wouldn't miss work I just had my friend drive me without doing a retest. Today was the last fail and says VIOLATION RESET in 5 days. I'm going to take it in to be be serviced, but wanted to know if anyone has this experience in Illinois?]]></description>

            <description><![CDATA[ The same thing happened to me word for word.  The ticket cost more then my trip down to Florida. After asking three times how much the ticket would cost the officer finally told me 200 PLUS around how fast I was going. I complained about the $286 (which I payed) but then the state sent me ANOTHER $200 bill months later which turned out to be the &quot;super speeder fine&quot;. Also they want an extra $30 to pay online and I'm getting mail from multiple law firms down in georgia who can see all this info? This is corruption. There should definitely be some sort of ground for a class action lawsuit. This is bad.<br />
please let me know. <br />

I am really disgusted that you would post that mess on here.  Yes, there are some lifelong criminal-types who get dui's, and also try to beat the device while all the while continuing to drive heavily. <br />

But MOST of us are just trying the best we can to get through the program and get our lives back in order. Many of us dont even drink at all. WE do not want to &quot;beat&quot; the system, we want to get through and survive the system.<br />

            <description><![CDATA[ Can any one recommend a traffic lawyer for Lenox, GA.  I was pulled over on I-75 (city of lenox, GA) a ticket was issued stating 97 in a 70 mile zone.  Other bogus citations were issued along with this ticket. Reckless driving, improper lane change, improper stopping on parkway.<br />

            <description><![CDATA[ Just like anything else, there is a margin of error for both the device, and the user, and for the system itself.<br />

When I received a similar letter six months ago, I was also shocked b/c I knew of a few issues, but I also knew I had nothing to drink for a very long time, and that it had to be an error somwhere. It was so demoralizing to think I could lose my lisence b/c of  a technical error.<br />
<br />
I requested my file, and was shocked to see how many &quot;rolling fails&quot; I had, when I had not had anything to drink, and the machine didn't give me any warrning upon starting my car. I really sat and studied it. I knew about the times I had eaten in the car and got a rolling .03, then it was down to a .000 5 minutes after swishing with water. All the other ones, I had no idea at all.<br />
<br />
So, after realizing I was &quot;blowing numbers&quot; despite no drinking, I decided to stop my life-long habit of eating in the car, and I always keep water in the car just in case of some other weird fluke. <br />
<br />
Like you, I have also had times where the device just acted schizo, and had all kinds of weird, nonsensical messages on it. Both times this happened, I immediately had the handset switched out, and filled out an explaination form about it.<br />
<br />
Early-on I also had some times where I was about to park and was asked to blow right before. In my logical mind, I thought &quot;I dont have to blow, I am about to stop driving in 30 seconds.&quot; But the machine sees that as a &quot;ignoring&quot; to blow. So, I've learned I must blow each and every time it requests, even if it doesnt make sense.  <br />
<br />
I also am a little hyper, so sometimes I tend to absent-mindedly turn the ignition switch on before the device actual says the words &quot;you may start vehicle now.&quot; As, I had already blown, and I have nothing to drink so I know its going to pass, but I start the ignition prematurely. So, I've had to slow myself down on that too, and just move slower.<br />
<br />
The bottom line is, it sounds like you have had some device failure plus some user issues, with just trying to get used to the device. I say, get your paperwork in order and get an appointment for the appeal.  Tomorrow, call NC DMV and explain, they should be able to rescend the &quot;immediate&quot; suspension until your hearing, which would probably end up being 2-3 months from  now. <br />

            <description><![CDATA[ I'll just stick with the basics since I tend to ramble once I start telling an actual story. <br />
<br />
Got two DUIs back in 2001 within a few months of each other, lost license.<br />
<br />
Went to inpatient rehab/treatment on May 5, 2002, stayed a year. Sober ever since.<br />
<br />
Decided a couple of years ago to get my license back. Paid my fines, took the classes and had the Monitech device installed. That was March of 2012. I'm required to maintain it for three years and I'm fine with all of that. I'm just glad I didn't kill someone back in the day.<br />
<br />
Uneventful except for a faulty unit there in the beginning, a couple of timeouts from not blowing hard/soft enough here and there  and a &quot;false start&quot; last February. I had no idea what was going on but the device was going crazy. I drove straight to the service center. <br />
<br />
The technician then told me what happened-  I'd started the car, forgot something in thOe house, turned it back off to go back inside, then went back to the car and drove off. He had me write a few sentences saying I didn't know before that day what a false start was (which I didn't) and that I now understood and it wouldn't happen again. There was no charge.<br />
<br />
A few days ago, I get a letter saying my license is suspended effective tomorrow. No reason, I called the DMV and they said Monitech reported a possible violation. I said it was impossible. When she told me the date I didn't argue anymore and said Iwould send in my written request for an appeal. She was nice and said that was fine. I got the fax number and sent it in.<br />
<br />
Has anyone else heard of anything like this at all? I called Monitech twice to talk to two individuals independantly. Both said they didn't see any fails ever on my report. They both said they'd send me my files but I don't know what the files contain. The point is, we've never had an issue with the device. Has anyone else been called into the DMV for a purely technical issue with no alcohol reading at all? Any feedback as to what is going on in my life right now would be appreciated because I am thoroughly confused.]]></description>

            <description><![CDATA[ If you read the forums you can see where people also had lack of issues with their devices.<br />

But,  since you must insist on me doing the homework for you,  The most positive ones were draeger and smartstart.  Some people choose draeger since it may be more user-friendly.  The smart start has a hum you have to do that some people just can not get right. I had the smart start and after a brief learning curve with the device I had absolutely NO issues at all with it.  There are some people who also had no issue with Lifesaver.  <br />
<br />
One suggestion is to get a device you can unplug and take inside with you at night or whenever.  It will help deter the theft of the device as well as when it gets cold the device tends to bog down a bit and it is slow to heat up when left outside in low temps. <br />
<br />
Having to go in for calibration is dependent on the type of error.  Your state should have that info for you.  Also,  you can read the forums and get some general ideas of different people's experiences with being called in for re-calibration.]]></description>
